These Terms and Conditions (“Terms”) govern your access to and use of the Roccomotive website (“Website”) and the purchase of any products or services offered by Roccomotive (“we”, “us”, or “our”).

2. Eligibility

By using this Website, you confirm that you are at least 18 years of age and legally capable of entering into a binding contract under Australian law.

3. Products and Services

3.1 Product Types

Roccomotive offers:

  • Custom 3D-designed and manufactured automotive parts

  • Third-party automotive parts

  • Digital design files, including but not limited to CAD, STL, STEP, or similar formats

  • Automotive design and engineering services

3.2 Custom and Made-to-Order Products

  • Custom products are manufactured specifically to order.

  • Once production has commenced, orders cannot be cancelled or changed, except where required by law.

  • Minor variations in colour, surface finish, or material may occur as part of the manufacturing process.

4. Digital Design Files

4.1 Delivery

  • Digital files are delivered electronically via download link or email.

  • Delivery is deemed complete once the file is made available to you.

4.2 License and Permitted Use

Unless otherwise stated in writing:

  • Digital files are supplied under a non-exclusive, non-transferable licence

  • Files may be used for personal or internal business use only

You may not:

  • Resell, sublicense, or redistribute files

  • Share files with third parties

  • Use files for mass production or commercial resale without written permission

4.3 No Refunds for Digital Files

Due to the nature of digital products, change-of-mind refunds are not available once a file has been delivered.

5. Vehicle Compatibility and Fitment

6. Road Use, Off-Road Use, and Motorsport

Unless explicitly stated otherwise:

  • Some products and digital designs are intended for off-road, motorsport, or competition use only

  • Not all products are ADR-compliant or legal for road use in all jurisdictions

  • You are responsible for ensuring compliance with all applicable vehicle standards, laws, and regulations

 

Roccomotive makes no guarantee of road legality unless explicitly stated in writing for a specific product.

7. Pricing and Payment

  • All prices are in Australian Dollars (AUD) unless otherwise stated

  • Prices include GST where applicable

  • We reserve the right to change pricing at any time

  • Orders will not be processed until payment has been received in full

8. Shipping and Delivery

Shipping methods, costs, and estimated delivery times are outlined in our Shipping Policy, which forms part of these Terms.

Delivery timeframes are estimates only and are not guaranteed.

9. Returns, Refunds, and Consumer Guarantees

9.1 Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

9.2 Custom Products

  • Custom or made-to-order products are not eligible for change-of-mind returns

  • This does not affect your statutory consumer rights

9.3 Digital Products

  • No change-of-mind refunds once files are delivered

  • Defective or incorrect files will be corrected or replaced where required by law

9.4 Third-Party Products

Returns for third-party products are subject to supplier conditions and our Returns Policy.

10. Installation and Use

  • Products should be installed by a suitably qualified professional unless otherwise stated

  • Roccomotive is not responsible for damage, injury, or loss resulting from improper installation, modification, or misuse

  • All products are used at your own risk to the extent permitted by law

11. Intellectual Property

All content on this Website, including but not limited to:

  • 3D designs and CAD files

  • Drawings, images, and documentation

  • Logos, branding, and written content

remains the intellectual property of Roccomotive or its licensors.

You must not copy, reproduce, modify, or commercially exploit any content without our prior written consent.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Roccomotive is not liable for indirect or consequential loss

  • Our liability is limited to the repair or replacement of goods, or the cost of repair or replacement

 

Nothing in these Terms excludes rights under Australian Consumer Law.

13. Third-Party Links and Products

We may provide links to third-party websites or sell third-party products. Roccomotive is not responsible for their content, accuracy, or availability.

14. Privacy

Your use of this Website is governed by our Privacy Policy.

15. Changes to These Terms

We may update these Terms at any time. Updates take effect once published on this Website.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia, and you submit to the exclusive jurisdiction of its courts.
